Care Plan terms
Hosting and ongoing care. Strandline, a service of Apace Active LLC. Oceanside, California.
1. What the Care Plan is
The Care Plan keeps your website hosted, healthy, and current after launch. It starts on the day your site goes live and renews automatically. You can pay monthly, which renews each month, or annually, which renews each year. Annual plans are billed for ten months of the monthly rate, so two months are free.
2. Plans and what's included
Every plan includes the same foundation:
- Hosting on modern managed infrastructure, with SSL and a global content delivery network.
- Software updates and security patching for the site.
- Monitoring, and my attention when something looks wrong.
- Email support. I aim to acknowledge within [one] business day and to complete small changes within [two] business days. These are targets, not a guaranteed service level.
- Minor fixes, such as a broken link, a typo, or a swapped photo or phone number.
What changes by plan is the amount of content-update work included each month and how quickly it is handled:
- Essential. The foundation above, with minor fixes. Larger content changes are quoted separately or covered by a higher plan.
- Plus. Everything in Essential, plus up to 60 minutes per month of content updates (text, photos, hours, menus, prices, and similar), with priority turnaround.
- Pro. Everything in Plus, plus support for an online store, up to 120 minutes per month of content updates, and faster response targets.
Unused monthly time does not roll over. The fee for your plan is shown when you subscribe and on each invoice.
3. What is not included
Redesigns, new pages beyond simple additions, new features or integrations, marketing and advertising management, copywriting beyond small edits, and recovery from problems caused by third parties or by changes you make yourself. I will quote that work separately in writing before doing it.
4. Billing
The Care Plan is billed automatically to the card or bank account on file: monthly plans each month, annual plans once a year. I can change the price with at least 30 days written notice, and the new price applies starting with your next billing cycle after the notice period. If a payment fails, the charge will be retried and I will let you know. If the account is more than 15 days past due, I may suspend the website until the balance is paid.

5. Canceling, and what happens when you leave
You can cancel with 30 days written notice; email is fine. Annual plans are prepaid for the year and are not refunded if you cancel mid-term, but you are free not to renew.

When you leave, I will provide an export of your site content and reasonable help pointing your domain wherever you choose, at no extra charge. Your domain is yours and remains in your registrar account throughout. After cancellation takes effect, hosting ends, and I delete my copies of the site after [60] days unless you ask me to delete them sooner.
6. Uptime and third parties
I host on reputable platforms, but I do not control the internet. I do not guarantee uninterrupted uptime, and I am not responsible for outages, changes, or failures of third-party providers, including hosting platforms, domain registrars, email services, and payment processors. When something breaks, I will work in good faith to restore service promptly.
7. Acceptable use
The website may not be used for anything unlawful, deceptive, or harmful, or to distribute malware or spam. I may suspend service immediately for violations.
8. Liability
My total liability under the Care Plan in any 12-month period is capped at the amounts you paid for the Care Plan during that period. Neither of us is liable to the other for indirect or consequential damages.
9. General
The Care Plan continues until it ends as described in Section 5. California law governs, and any dispute will be resolved in the state or federal courts located in San Diego County, California. These terms, together with your Website Project Agreement, are the entire agreement for the services.
How you accept these terms
You accept these terms when you subscribe to a Care Plan, including by checking the acceptance box at checkout, or by signing them as part of your Website Project Agreement.
